Sir James Mumby suggests radical streamlining of matrimonial law
A Senior Family Court Judge has indicated that couples agreeing to divorce by consent should be allowed to arrange their own separation with a trip to a Registrar rather than having to go to Court. Sir James Mumby, the most senior family Judge in England and Wales, suggests radical streamlining of matrimonial law. Sir James Mumby is president of the High Court Family Division and has urged Ministers to give unmarried couples living together the same rights as married couples, suggesting that some women are being thrown on the scrapheap without any financial support if their relationship ends.
The Judge suggests that an uncontested divorce could do away with the need for judicial supervision with couples instead simply recording their separation with a Registrar of Births, Deaths, Marriage & Divorces. The idea is likely to cause considerable controversy. Until however such suggest receive statutory approval it is unlikely to impact upon the current system.
