Separating Parents and Moving Abroad

England’s most senior female family court judge, Lady Hale has recently indicated that the views of the child/children should be taken into consideration, when parents are separating  and one of the parents wishes to move overseas with the children. This could have a significant impact, effectively allowing children to play a pivotal role in determining  the parents life choices,  in that the court considered that the child/children  should according to Lady Hale  allow children to be seen “as people with a part to play in their own lives, rather than as passive recipients of their parents’ decisions.”
