MAKING A WILL

By writing a Will you make your wishes clear as to who benefits from your assets in the event of your death. We at Clarkson Hirst are happy to assist you in drawing up a Will that meets your requirements and ensures that your wishes can be achieved.

When making a Will, it is important that the Will contains certain information, namely: -

Who do you want to appoint as an Executor?

An Executor is the person or persons whom have the job of giving effect to the terms of your Will. The Executor(s) are the persons responsible for applying for a Grant of Probate, collecting in your assets, discharging your liabilities and distributing the remainder in accordance with your Will as well as complying with any other wishes you may have expressed in your Will.

When appointing an Executor you can choose to appoint adult family members or if you prefer the partners at Clarkson Hirst Solicitors can act as your Executors instead.

Burial or cremation?

It is possible if you wish to include a paragraph within your Will to indicate your preference for burial or cremation.

Legacies

You may want to include within your Will a request that certain items, i.e. personal possessions such as jewellery or special objects be passed on to a particular individual. If there is anything specific you would like to pass to a named individual this can be incorporated within your Will. It is also possible to include financial legacies for example if you wish to give a specific amount of money to a specific individual you can include your preference for this within your Will.

Property

If you own a property either in your sole name or with other persons you may wish to consider including within your Will details as to how you would wish that property to be dealt with in the event of your death. We can draft a Will on your behalf which can include allowing a loved one the right to remain living in that property after your death allowing them to live in that property during their lifetime and then passing on to another individual. This will depend on how you own property and we will need to discuss this with you further at the time of making your Will.

Dealing with the Residue

The Residue of your estate is essentially everything that is left after any specific gifts and payment of funeral expenses and liabilities. If you do not identify an asset individually it forms part of the residue of your estate. We would include a paragraph within your Will detailing who you would like to inherit the residue.

Substitution

You may wish to consider appointing a substitute beneficiary in case the intended beneficiary dies before you.

Guardian

You may appoint a Guardian for your children in the event of your death or the death of your partner. We can include an appropriate paragraph to appoint a guardian.
